What the hell do my T&Cs have to do with my real estate agency’s brand?

O*NO! What do you mean my terms & conditions should reflect my brand attributes? I thought it was ok that they sounded like a super boring lawyer wrote them…

Brand Attributes

Everything you put out into the public domain reflects who you are, it reflects your brand.

When you think of your brand, what do you think of?

At O*NO Legal, we are vibrant, cheeky, game changers and dare to be different!

What are your brand attributes?

Brands and Contracts

You may be thinking: what on earth do my brand attributes have to do with my contracts?

Let’s start here - when you think about contracts and terms & conditions, do you immediately yawn and get bored?

Now think about YOUR terms & conditions. Do you have the same reaction? Imagine how your clients feel when they receive your T&Cs from you. Is it a good customer experience, or are they as bored as you are?

These T&Cs come in many forms, and you would use several in your agency – your agency website T&Cs, privacy policy, listing agreements, management agreements, disclaimers in your marketing – the list goes on.

Let’s go back to our opening statement - everything you put out into the public domain reflects who you are, it reflects your brand. This includes your contracts and your terms & conditions. Do your T&Cs reflect your brand? Could your clients pick your T&Cs out of a lineup of other real estate agent’s contracts?

But contracts are super legal – aren’t they meant to be boring?

Ok, ok. Yes, contracts can be boring and yes, they do have to have certain things in them to make them ‘compliant’, but they can still have your voice. They can still sound like you.

So how can you align your T&Cs with your brand?

  • Instill your brand attributes in your documents.

  • Use the same language you would use when speaking with clients, rather than legalese.

  • Have a little fun - have you read our full disclaimer below?

You wouldn’t let a staff member put up a For Sale or Lease sign that wasn’t in your brand’s colours – so don’t let your T&Cs work against you either.

Takeaways

  • Haven’t read your website T&Cs, Listing Agreement or Management Agreement for a while? Then read them!

  • Do the words sound like you, or do they sound like a pretentious lawyer? If they don’t sound like you, change them!

  • Check to see if your T&Cs look like your brand. Do they have your logo, colours and fonts?

  • Align your T&Cs with your brand.

Remember, EVERYTHING that you put out into the public domain needs to reflect you, your brand, and your agency.
